Rights to privacy

Find Aged Care Pty Ltd (ACN 636 303 734) (Find Aged Care, FAC, we, us, our), understands the importance of protecting an individual's right to privacy.

This privacy policy sets out how we aim to protect the privacy of your personal information, your rights in relation to your personal information managed by us and the way we collect, hold, use, disclose and otherwise manage your personal information.

In handling your personal information, Find Aged Care complies with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs) under the Privacy Act.

We regularly review our practices and procedures regarding how we collect, hold, use, disclose and otherwise manage personal information. As a result, we may updated this policy from time to time. Where we update this policy we will make the updated policy available, including on our website located at www.findagedcare.com

What kinds of personal information does FAC collect?

For the purposes of the Privacy Act, personal information is information or an opinion, whether true or not and whether recorded in a material form or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.

The kinds of personal information we collect from you depends on your individual circumstances, and may include:

  1. your name, residential address, email address, telephone and other similar contact details;
  2. your date of birth and marital status;
  3. your home address if it is not also your residential address;
  4. contact details of your current aged care provider;
  5. contact details of your doctor/s and any other persons who are responsible for your care;
  6. name, residential address, email address, telephone and other similar contact details of your next of kin and any person who has your authority to act as your guardian or attorney;
  7. information about your pension, including pension type and pension number;
  8. your Health Care Card, Medicare Card and Pensioner Concession Card details;
  9. information about your private health care fund, including the name of the fund and your member number; and
  10. contract details of your financial planner or accountant.

We may collect and hold sensitive information about you. Information about your health, racial or ethnic origin, political persuasions, criminal record and religious or philosophical beliefs are all examples of sensitive information.

Specifically, we will collect and hold information about your health (including information about your physical and medical needs), and information about your preferred language or your ethnicity. We collect and hold this type of sensitive information to assist in identifying aged care providers who may be most suitable for your needs, and to send your application details to an aged care provider of your choice.

How does FAC collect personal information?

We will collect personal information about you in a number of circumstances, including, when:

  1. you visit our website;
  2. you log in to our platform; and
  3. contact us directly to make an inquiry about our services.

We will generally only collect your personal information directly from you. However, in some circumstances we may collect personal information about you from another party where it is unreasonable or impracticable to collect it from you. For example, if your health prevents you from providing us with your personal information and you have authorised another person to represent you, such as a next of kin or a doctor.

Why does FAC collect your personal information?

We collect, hold, use and disclose your personal information to provide you with our services, which includes collecting, holding, using and disclosing personal information to:

  1. process your request to be matched to an aged care provider;
  2. manage and administer your request to contact an aged care provider;
  3. to send your application details to an aged care provider of your choice;
  4. provide information about you to your chosen aged care provider to facilitate your application to an aged care provider of your choice;
  5. respond to your queries; and
  6. administer, evaluate and improve our services including by using data analytics technology.

You are under no obligation to provide your personal information to us. However, if you do not provide us with your personal information or provide us with incomplete or inaccurate information:

  1. it may limit our ability to provide you with a suitable selection of aged care providers;
  2. we may not be able to best assist you in identifying aged care providers who may be most suitable for your needs;
  3. successfully send your application to an aged care provider of your choice; and
  4. we may not be able to properly respond to your queries or requests for information.

If you have consented, we will hold your personal information, including your sensitive information and make it available to you (including on our websites or online platforms) for up to two years from the date you complete your dealings with us, for the purpose of you reusing our services at a later date during those two years. We may retain personal information for a longer period where necessary for the provision of our services or where we are required to do so by law.

Who does FAC disclose your personal information to?

We will only disclose your personal information to third parties for the purpose that we collected it from you or as you would reasonably expect us to do, including for the purpose of providing you with our services. We may also disclose your personal information to third parties for other purposes with your consent, or if the disclosure is required or authorised by law.

The types of organisations to which we may disclose your personal information to include:

  1. aged care providers;
  2. our professional advisers (including legal and accounting firms, auditors and consultants); and
  3. Government authorities to the extent required by law or to comply with a lawful request for such an authority.

We may disclose your information about you to universities for the purposes of research and study. If we do use and disclose your information in this way we will de-identify your personal information (by permanently removing identifiers such as your name, address, Health Care Card, Medicare Card and Pensioner Concession Card numbers) prior to disclosing it to those organisations.

We do not engage in direct marketing and we do not disclose your personal information to recipients based overseas, and we do not currently have established plans to do so.

Any links on our website to other websites, including sites operated by including aged care service providers (who are independent third parties) are provided as a convenience to you. Each website has its own privacy practices, as described in that site’s privacy policy. Those practices may be different than the practices described in this privacy policy, and we encourage you to read each website’s privacy policy carefully before you use or submit information to that site. Additionally, to the extent that you follow a link to a website operated by an independent third party, please be aware that we exercise no authority or control over that third party, and cannot and are not responsible for any information that you may submit to that site.

Security of your personal information

FAC takes steps reasonable in the circumstances to ensure that the personal information it holds is protected from misuse, interference and loss and from unauthorised access, modification or disclosure.

Your personal information will be kept on databases held on servers kept in a physically and technologically secured environment, accessed only by authorised personnel or contractors. Where personal information is held in hard copy, it will be held in controlled, access restricted premises which only authorised personnel or contractors will be permitted to access.

FAC will destroy or de-identify personal information in circumstances where it is no longer required, unless you have consented to us holding the information for up to two years in expectation of using FAC services again in that time, or FAC is otherwise required or authorised by law to retain the information.

Can you access or correct the personal information that we hold about you?

FAC takes steps reasonable in the circumstances to ensure that the personal information it collects, holds, uses and discloses about an individual is accurate, complete, up-to-date, relevant, and is not misleading.

Under the Privacy Act, you have a right to request access to or correction of your personal information that we collect and hold.

If at any time you would like to request access to or correction of the personal information we hold about you, or you would like more information on our approach to privacy, please contact our Compliance Manager, using the contact details set out below.

To obtain access to or correction of your personal information, we may request that you provide us with proof of your identity. We make this request, as it is necessary to ensure that we only provide personal information to the correct individuals and to protect the privacy of other individuals.

Upon receiving a request for access to or correction of personal information, we will review the request, make a decision regarding the request and notify you of that decision.

We will seek to respond to requests for access to or correction of personal information within 30 days of the date of the request.

In some circumstances, we may charge a fee for the cost of providing you with access to your personal information (for example, where providing access requires a detailed retrieval of your personal information). Such a fee will not exceed the reasonable cost to FAC of providing access.

If you believe that we have not dealt with your personal information in a manner that complies with the Privacy Act or the APPs, you can make a privacy complaint to us.

Please direct all privacy complaints to FAC’s Compliance Manager in writing using the contact details set out above.

At all times, privacy complaints:

  1. will be treated seriously;
  2. will be dealt with promptly;
  3. will be dealt with in a confidential manner; and
  4. will not affect your existing obligations or affect the commercial arrangements between you and us.

Upon receipt of your complaint, we will commence an investigation into your complaint.

We will inform you of our response to your complaint following the completion of the investigation. We will seek to respond to privacy complaints within 30 days of the date of the complaint.

In the event you are dissatisfied with the outcome of your complaint, you may refer the complaint to the Office of the Australian Information Commissioner.
